SWIM was arrested on a mandatory arrest situation for saying the wrong words to a very misleading question from a police officer bent on taking him into custody. SWIM did not understand his rights back then, nor the motives of some law enforcement officials and his only crime was being gullible in trying to be cooperative with Police and thinking they were actually going to help him in the situation he was facing.

One thing went wrong and another, this incident became a living nightmare. He was not allowed his pain medication or his anti-anxiety medication which he took for Intractable pain (A terminal condition), the amygdala in the brain goes into permanent fight/flight distress because of the constant nerve activity and this man suffered from panic disorder all day, every day because of it. Being abruptly taken off this medication and in a county jail bunk type lockup was akin to locking a claustrophobic man into a coffin and pounding on it with mallets for 5 days. Subsequent violations of his rights as well as some pretty inhumane treatment only brought this situation to something more like torture. After not sleeping for 4 days, being unable to eat, having nobody pay attention to his requests for medical attention, medication and psychological distress he was shackled in chain gang formation for an hour, led to a bus where he was then shackled to another man for a 2 hour drive to the courthouse basement. In the basement the shackles were kept on, despite being in a maximum security facility behind huge steel doors and an officer/inmate ratio of approx. 1/3. When unshackled from the other man he remained himself in full shackled restraints (chains around the ankles, chain leading from ankles to waist, chain around waist, handcuffed with 3 sets of handcuffs to the waist and long chain) which were then tightened around his waist. Already unable to breathe due to the panic attacks, after 2 more hours of being shackled so tightly SWIM found it hard to breathe and made repeated attempts to have his waist chain simply loosened and this was denied when he wasn’t being ignored. When chest pains became a terror, not only due to being taken oanti anxietyanxiety medicine, but because this medicine is notorious for causing problems such as seizure, coma and death when being taken off it, SWIM told a sheriff’s deputy who promised to get hepl, didn’t twice. He then used the emergency button on the wall and was told via intercom that if he could talk (By calling for help) then he could breathe, to "sit down and shut up to save oxygen consumption". Another inmate witnessing this made an attempt to call for emergency service and was denied. By this time SWIM realized he was in a fight for his life and that nobody cared if he lived or died since he was "accused" of a crime, he made up his mind to try and get through until court and find some help there. When in court he was notified that his fiance had suffered a heart problems and was taken to the hospital the night before, after being resuscitated a medical check discovered she was pregnant with twins and also diagnosed with cancer. Explaining all this to the public defender he was told to plea and he would receive probation, if he didnt plea there was nothing that could be done about any of his problems and he would have to wait up to 45 days for a trial or some other nonsense he is unable to exactly remember. What he did know was that another day without medical attention could mean death and was certainly excruciating, physically and psychologically because of his medical condition. While waiting for his witness, the lynch pin to prove his innocence, the PD had told her the wrong floor the courthouse was on. The PD told the judge she was in the building but they needed 5 minutes to get her down there the judge stated " There’s no need of a witness for the defendant, we all know what she’s going to say about his innocence, lets proceed". Horrified, SWIM made his plea, planned on going to the ER as soon as he was released and file charges concerning all of this. SWIM became much more ill and troubled after this incident and was finally placed into psychiatric care after the death of the twin babies due to cancer in the mother. 6 months later he was able to function and called the PD to withdraw his plea and was told the statute had run out and nothing could be done concerning anything that had happened. He then visited a private attorney and explained his whole matter but the attorney gave him a discourse on theology then told him he would be wasting his time, to thank the attorney for saving him thousands of dollars and his time in court and then told him he should be happy to only pay 75 dollars for the consultation (Which was supposed to be free).

SWIM wants no part in dealing with this matter, he is completely frightened of law enforcement and the judicial system and has moved across the country to start a n
SWIM wants nothing to do with CALIFORNIA & the nightmare case, not information on whether he can put his mind at ease or not. I thought I stated that he was worried about moving and I am asking for him so he doesnt have to rehash the entire matter in his mind. After this happened, one of the therapeutic exercises was to write the entire event down, in as much detail as possible and deal with each and every emotion regarding the trauma. Also, I have a copy of the entire situation becuase it was written in a letter that was sent to the ACLU to explain grievances against the corrections dept., the local PD and the presiding judge. What he’s been told and explained to me was the amount of shock he went into when pretty much everything he believed in, truth, justice, decency of humanity, was shattered by figures we hold in our mind to be our protectors and helpers when we are innocent of a crime, instead these people put his life in peril and showed no mercy or humanity & did it with POWER.
